Legislative News


BANKRUPTCY ALERT: Senator Durbin has introduced legislation to allow debtors to cram down modified terms on mortgages secured by debtor's primary residence. No word on the House. It is a vitual certainly some legislation will be passed, especially with major lenders like Citibank withdrawing their objections--they need bailout money.

Alabama Legislative News
SB46: amends the Alabama Small Estate Act increasing threshhold amount from $3,000 to $25,000. The bill has passed the Senate and is currently at the House.

SB90:  adopts the Alabama Uniform Real Property Electronic Recording Act. The bill is currently in the house.

HB18: would remove the partial disability benefits cap. It is still pending in the House.

HB23:  would make agreements to submit future disputes to arbitration enforceable. It is still pending in the House.

HB157: would prohibit text messaging while operating a motor vehicle on public streets. It is now in the Senate.

HB158:  would prohibit cell phone use while driving subject to certain exceptions. This bill is still in the House, has had its second reading.

Recent Decisions

ANTI-RETALIATION PROTECTION: The U. S. Supreme Court recently extended the protection of Title VII against retaliation to employees who speak out not of their own volition, but in response to questions posed during an employer's internal investigation. There was no pending EEOlC charge. Crawford v. Metropolotin Government of Nashville, __ U. S. __ (2008).
